Is Your AI Chat History Discoverable?

AI tools like ChatGPT, Claude, and Gemini are now everyday workhorses helping draft emails, test legal arguments, and tackle tough problems but that convenience comes with a growing legal catch: those chat histories are often discoverable in lawsuits. Prompts and responses usually qualify as electronically stored information (ESI), just like emails or Slack threads, and can expose sensitive internal strategy, compliance discussions, or early legal thinking if they’re relevant. As courts treat more digital conversations as fair game for evidence, companies without clear rules for saving, managing, or deleting AI interactions risk serious headaches, including sanctions for failing to preserve what turns out to be key evidence.
